Who is the Data Controller?

The Data Controller is AccessiWay Srl, VAT number 12419990010, with registered office in Via Giuseppe Giacosa, 38, 10125, Turin (TO).

Who will process your data?

Your data is processed by the internal staff of AccessiWay S.r.l. (hereinafter "AccessiWay") duly trained and specifically authorized. In addition, your data may be processed by our suppliers only for organizational and functional needs related to the performance of services requested by you (see paragraph "With whom we can share your data?").

What personal data do we collect?

Personal data is any information that identifies the user (hereinafter "User").

The categories of information that AccessiWay collects and processes when the User accesses the site are as follows:

  1. At the time of registration to the site, we collect Your first and last name or that of the contact person of the Company, address of residence and/or registered office, email address, email address for declaration of accessibility for each domain and/or for each individual national top level domain (ccTLD), company role, tax code, telephone number and domain(s);

  2. At the time of purchase of the service, we collect all the data referred to in the previous point, if You are not yet registered on the site, in addition to the payment details, which will be handled by an external service (credit/debit card, billing address or other payment details such as card owner's email, card expiry month/year and Stripe/Paypal ID), or payment information by bank transfer (IBAN and account holder);

  3. Information about Your preferences regarding the products and services that Accessiway offers;

  4. Browsing data such as the website from which the page was retrieved ("referral"), the IP address, the date and time of the request or access, the request from the visitor's browser or other client and the operating system used;

  5. Data relating to the real-time geographic location of your device via IP address, Bluetooth, crowd-sourced wi-fi hotspots and location of repeaters if you use location-based features by activating geolocation services on your device and/or computer;

  6. Communications, including data provided by you when using the customer support chat service on the website, exchanged with us or addressed to us by letter, email, the website chat/messaging service or social media;

  7. Where you are a User and you decide to contact us by completing the request form provided on the Website, we will also collect the information you share with us by completing the form.

Conversely, in the case of the purchase of the "Software as a Service" (hereinafter "SaaS") licence, no data from the end users of the buyer's website will be collected and processed by AccessiWay pursuant to the licence.


Purpose of processing

The personal data supplied by you and collected on/from the site www.accessiway.com and app.accessiway.com will be used for the following purposes:

  1. to conclude and execute the contract for the purchase of products and/or services offered on www.accessiway.com and app.accessiway.com.
    We would like to remind you that, on this occasion, you will be asked for the data referred to in points 1) and 2) of the previous paragraph ("What personal data do we collect?") in order to correctly execute the contract for the purchase of the product/service, and we will carry out the appropriate checks if you choose a credit/debit card or bank transfer as the method of payment;

  2. Use of the services offered by the site;

  3. Handling of your requests for assistance to our customer service;

  4. Analyses and statistical surveys in order to improve or adjust our services in relation to users' preferences, as well as to ensure the regular and correct functioning of the site;

  5. Sending commercial and promotional communications regarding products and services similar to the products you have purchased or the services you have used (so-called soft-spam);

  6. Only with your express consent, to propose advances, exclusive offers, promotional initiatives promoted by AccessiWay and commercial communications tailored to your interests. These communications (c.d. Newsletter) will be sent by email to the email address you have provided during registration or purchase.

Finally, we inform you that, at the request of the Judicial Authority, the data could be used to ascertain responsibility in case of hypothetical computer crimes against AccessiWay of the site www.accessiway.com and app.accessiway.com or its Users.

The provision of your personal data for these purposes, except those referred to in paragraph 5) is a contractual obligation. You are free to provide us with your data or not, but without the required data we will not be able to conclude or execute the contract and your requests. This means that you will not be able to purchase the services provided by www.accessiway.com and app.accessiway.com and your requests cannot be processed.

Legal basis of processing

The legal basis for the processing of the personal data referred to in this information notice is given, as the case may be, by:

  1. consent of the data subject;
  2. contractual relationship;
  3. legal obligations.

How we process and keep secure your data?

Your personal data collected on/from the website www.accessiway.com and app.accessiway.com will also be recorded on electronic databases owned by the data controller and will be processed by the company in accordance with the principles of correctness, lawfulness and transparency and with methods and procedures necessary to provide the services requested.

The treatment will be carried out in paper and / or automated form, in compliance with the provisions of art. 32 GDPR 2016/679 on security measures, by persons specifically charged by AccessiWay and in compliance with the provisions of art. 29 GDPR 2016/679.

It should be noted that for the protection of the data acquired, the Data Controller adopts technical and organizational measures appropriate to the purpose of the treatment itself (so-called privacy by design and privacy by default). Strict security procedures are followed in the storage and disclosure of personal data, to protect them against accidental loss, destruction or damage. The data that you have provided to us as well as the data transferred to us by our business partners are protected with TLS 1.2 (Transport Layer Security) technology, which is the standard method of encrypting personal data and credit card numbers that enables their secure transfer over the Internet.

All payment data is transmitted via TLS 1.2 throughout the dedicated network infrastructure and stored in accordance with the Payment Card Industry Data Security Standards (PCI DSS).

In the event of a breach of the aforementioned protection measures for the personal data acquired, we will, as the data controller, without undue delay notify the supervisory authority of the breach - and, where possible, within 72 hours of becoming aware of it - if such breach presents a risk to the rights and freedoms of natural persons. In such a case, we will promptly send You a notice indicating the data breached.

If AccessiWay has given You (or You have chosen) a password to access the website/app and/or the services provided (such as, for example, the "Newsletter"), You will be responsible for maintaining the secrecy of that password and, where additional security procedures have been communicated to You, any breach resulting from a failure to comply with such procedures will be Your sole responsibility.

Finally, we may disclose your information to trusted third parties for the purposes set out in this Privacy Policy in the paragraph above ("Purposes of Processing"), specifically for the proper provision of the services you have requested and to comply with legal obligations (e.g. electronic billing obligations). We require all third parties to take appropriate technical and operational security measures to protect personal data that are in line with Italian and EU legislation on data protection standards.


How long and how do we store your data?

Your personal data collected will also be recorded and stored on protected electronic media and processed with appropriate security measures, including associating and integrating them with other databases.

AccessiWay uses cloud services, using suppliers selected from those who provide adequate guarantees. In accordance with the principles of lawfulness, purpose limitation and data minimization, pursuant to art. 5 GDPR 2016/679, subject to the release of your free and explicit consent, your personal data will be stored for the period of time necessary to achieve the purposes for which they are collected (the retention period varies depending on the nature of the purpose of processing) and in any case until your request for cancellation made through the site www.accessiway.com and app.accessiway.com or by registered letter and in accordance with the retention periods provided for by law.


With whom we may share your personal data?

We inform you that the data collected will not be disclosed and will not be communicated without your express consent, except for the necessary communications to third party companies that perform tasks of a technical or organizational nature on behalf of the company that are instrumental to the provision of services required for the proper execution of services purchased by you, as well as for the fulfillment of legal obligations (by way of example but not limited to, the Inland Revenue and the accountant used by the company).

Please note that, for the proper performance of the services offered, the data collected may be shared with companies with registered offices outside the European Union (by way of example but not limited to AccessiBe LTD, as owner of intellectual property rights on AccessiWay software and Systems), which are considered adequate with respect to the GDPR by virtue of the adoption of standard contractual clauses.

Communications for market research or commercial information on products and promotional initiatives may be made by mailing, always with your consent.
